MAUWATTA IMAM MALIK PREFACE IN THE NAME OF ALLAH, MOST GRACIOUS, MOST MERCIFUL Malek ben Anas, a Muslim jurist, the Imam of the Malikis doctrine, which is named after him. He was called briefly the Imam of Madina, Malek's full name was Abu 'Abd-Allah Malek ben Anas ben Malek ben Abu Amir ben 'Amr ben Al-Harith ben Ghayman ben Khuthayn ben 'Amr ben Al-Harith Al-Asbahi. He belonged to the Humair, who were included in he Bani Taym ben Murra. Malek's great work is Al-Muwatta' , which is the earliest surviving Muslim law-book. Its object is to give a survey of law and justice, ritual and practice of religion, according to the tradition applied in Madina, and to create a theoretical standard for matters which were not settled from the point of view of the tradition. In a period of recognition and appreciation of the canon law under the early Abbasids, there was a practical interest in pointing out a smoothed path (this is practically what Al-Muwatta' means) through the for reaching differences of opinion even on the most elementary questions. However Al-Muwatta' thus represents the transition from the doctrinal writings of the earliest period to the puree science of hadith of the later period. The success of Al-Muwatta' is due to the fact that it always takes an average view on disputed points. In transmitting Al-Muwatta', Malek didnot make a definite text, either oral or by dissemination.
